1. Acceptance of Terms

By downloading, installing, accessing, or using PozeFit ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will update the "Last updated" date above when changes are made.

2. Description of Service

PozeFit is a fitness application that uses AI-powered computer vision to analyze exercise form in real time. The App provides:

• Real-time pose detection and form scoring during workouts
• AI-generated voice coaching cues
• Post-set form analysis with detailed feedback
• Workout history and progress tracking
• Progress photo capture and comparison
• Integration with Apple HealthKit and Android Health Connect (read-only)

3. Eligibility

You must be at least 13 years old to use PozeFit. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the App.

4. Account Registration

To access certain features, you may need to create an account using your email address or a third-party provider (Google or Apple). You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Permitted Use

You agree to use PozeFit only for lawful, personal, non-commercial fitness purposes. You agree not to:

• Reverse-engineer, decompile, or disassemble any part of the App
• Attempt to gain unauthorized access to our servers or systems
• Use the App to collect data about other users
• Redistribute, sublicense, or resell the App or its content
• Use the App in any way that could damage, disable, or impair the service
• Use automated scripts or bots to interact with the App

6. Health & Fitness Disclaimer

PozeFit is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

• Not a substitute for professional advice: The form analysis, scores, and coaching cues provided by the App are AI-generated suggestions and should not replace guidance from a qualified personal trainer, physiotherapist, or medical professional.
• Exercise at your own risk: You are solely responsible for your physical wellbeing during workouts. Consult a healthcare provider before starting any exercise program, especially if you have pre-existing health conditions or injuries.
• AI limitations: Our AI analysis may not detect all form issues or injury risks. The form scores and feedback are approximations and may contain inaccuracies. Always listen to your body and stop exercising if you feel pain.
• No liability for injuries: PozeFit and its creators shall not be held liable for any injuries, health issues, or damages resulting from the use of the App or reliance on its feedback.

7. Intellectual Property

All content, features, and functionality of PozeFit — including but not limited to the software, design, text, graphics, logos, icons, and AI models — are the exclusive property of PozeFit and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. User Content

You retain ownership of any content you create through the App, including progress photos and workout notes. By using the App, you grant us no rights to your content beyond what is necessary to provide the service (e.g., processing photos for face-blurring, sending pose data to AI for analysis).

9. Third-Party Services

PozeFit integrates with third-party services including Supabase (authentication and data storage), Google Gemini AI (form analysis), and platform health services (HealthKit, Health Connect). Your use of these services is also subject to their respective terms of service:

10. Availability & Modifications

We strive to keep PozeFit available and functioning, but we do not guarantee uninterrupted or error-free operation. We reserve the right to:

• Modify, suspend, or discontinue any feature of the App at any time
• Perform maintenance that may temporarily affect availability
• Update the App to improve performance, security, or functionality

11. Limitation of Liability

To the maximum extent permitted by applicable law, PozeFit and its creators, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury, or loss of profits, arising out of or in connection with your use of the App.

Our total liability for any claim arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless PozeFit and its creators from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

13. Termination

You may stop using PozeFit at any time by uninstalling the App and, if desired, requesting account deletion by contacting us. We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice.

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including liability limitations, indemnification, and intellectual property) shall continue to apply.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PozeFit operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the competent courts of that jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
